Travelgram Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the Travelgram mobile application and related services (collectively, the "Service"), provided by Travelgram AI Inc., a Delaware corporation, with registered office at 1111b South Governors Ave Ste 82832, Dover, DE 19904, United States ("Travelgram," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. If a change is material, we will notify you through the Service (for example, an in-app notice or email). Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree, you may stop using the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction of residence) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Your Account

1. Some features of the Service require you to create an account. You may sign in using your Google account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
2. You agree to provide accurate and complete information in your profile (including your name and nationality) and to keep it up to date.
3. You must not create multiple accounts to circumvent any restriction imposed by these Terms or by the Service, and you must not share your account with third parties.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not:

• copy, modify, or create derivative works of the Service, its code, or its design;
• reverse engineer, decompile, or attempt to extract the source code of the Service;
• sell, resell, sublicense, or otherwise exploit the Service for commercial purposes without our prior written consent;
• use automated tools, bots, or scrapers to access or collect data from the Service.

5. User Content

1. The Service lets you create, upload, and share content such as trips, itineraries, spot notes, comments, avatars, and share cards ("User Content").
2. You retain all rights to your User Content. By uploading or creating User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to provide, operate, and improve the Service (for example, to display your shared travel map card to the recipients you choose).
3. You represent and warrant that you own or have the necessary rights to your User Content, and that it does not infringe the rights of any third party.
4. You must not upload User Content that is unlawful, defamatory, hateful, sexually explicit, harassing, or otherwise objectionable. We may remove any User Content that violates these Terms.

6. Photo Library Import and Location Data

1. The Travel Tracker feature may ask for access to your device photo library to detect countries you have visited based on the location metadata embedded in your photos.
2. By granting this access, you consent to the processing of such metadata (including geolocation) solely for the purpose of detecting and displaying visited countries. This analysis is performed to enable the feature; we do not use your photos or their location metadata for any other purpose. See our Privacy Policy for details.
3. You may withdraw access to your photo library at any time through your device settings. Note that features that depend on photo access will not function without it.
4. You are solely responsible for ensuring that you have the right to grant us access to the photos you import.

7. Trip Companions

1. The Service lets you invite other users to a trip using an invite code. When you join a shared trip, you agree that its content (including spot notes) will be visible to the owner and all companions of that trip.
2. You must not use invite codes or shared trips to send unsolicited messages or harass other users.
3. The owner of a trip controls the trip's content and companion list. We are not responsible for content added to a shared trip by other companions.

8. Third-Party Services and Content

1. The Service relies on third-party data and services, including spot and activity data, country statistics (World Bank), currency exchange rates, and map data (Google Maps).
2. Such content is provided for informational purposes only. We do not guarantee its accuracy, completeness, or currency.
3. Your use of certain features (for example, maps) may be subject to the separate terms and privacy policies of the relevant third-party providers. Google Maps data is subject to the Google Maps / Google Earth Additional Terms of Service.

9. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• interfere with or disrupt the Service, its servers, or networks;
• attempt to gain unauthorized access to any part of the Service, other users' accounts, or the systems connected to the Service;
• use the Service to stalk, harass, or harm any person;
• share, transmit, or display another person's personal data without their consent;
• use the Service in a way that could damage, disable, or impair the Service or other users' experience.

10. Premium Features and Payments

1. The Service is currently provided free of charge. Certain premium features may be introduced in the future and offered through a subscription or one-time purchase ("Premium Features").
2. If you purchase Premium Features, payment is processed by third-party payment providers (for example, the Apple App Store or Google Play). All transactions are subject to the applicable store's terms, and refunds are governed by the applicable store's refund policy.
3. We may change, suspend, or discontinue Premium Features or their pricing at any time, subject to any rights you may have under applicable law. Price changes will be communicated to you in advance.

11. Disclaimers

1. Travel is at your own risk. The Service provides planning tools and reference information (including safety, climate, transport, and emergency information). This information is provided for general guidance only and may be incomplete, outdated, or inaccurate. Always verify critical travel information from official sources (government travel advisories, local authorities, embassies) before and during your trip.
2. No travel agency. Travelgram is not a travel agency, booking platform, or tour operator. We do not sell, arrange, or guarantee flights, accommodation, activities, or any travel services. Any booking or arrangement you make is between you and the relevant provider.
3. The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by applicable law, neither Travelgram nor its officers, directors, employees, or agents shall be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service.

Our total aggregate liability arising out of or in connection with these Terms or your use of the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the claim, or, if you paid nothing, one hundred dollars (USD $100).

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Travelgram and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with (a) your use of the Service, (b) your User Content, or (c) your breach of these Terms.

14. Termination

1. We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including if you violate these Terms.
2. You may stop using the Service and delete your account at any time. Deleting your account removes your account and associated data from the Service, subject to legal retention requirements. See our Privacy Policy for details.
3. Sections that by their nature should survive termination (including Sections 11, 12, and 13) will survive any termination of these Terms.

15. Changes to the Service

We are continuously improving the Service. We may add, modify, or remove features, content, or functionality at any time, with or without notice. We are not liable to you for any such changes.

16. Governing Law, Arbitration, and Class Action Waiver

1. Governing law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.
2. Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved by binding individual arbitration, not in court, except that you may bring a Dispute in small claims court if it qualifies. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
3. Arbitration location and procedure. The arbitration will be conducted in English in the State of Delaware, unless you and we agree otherwise. Each party will bear its own costs and attorneys' fees, unless the arbitrator determines that an award of fees is required by applicable law.
4. Class action waiver. You and Travelgram agree that each party may bring Disputes only in its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.
5. Opt-out. You may opt out of the arbitration and class action waiver provisions within thirty (30) days of first using the Service by emailing support@travelgram.io stating your name, the email associated with your account, and your intent to opt out.
6. Severability. If any provision of this arbitration agreement is found unenforceable, that provision shall be severed, and the remaining provisions shall remain in force.
